     - Maintain the confidentiality of their account details, including passwords.

2. Buyer Role Responsibilities :

   : A Buyer uses the DesktopBazar marketplace to browse, select, and purchase products or services listed by Sellers.

     - Ensure all payment details provided are accurate and valid.

     - Review product descriptions carefully before making purchases.

     - Make payments promptly through the authorized payment channels on DesktopBazar.

     - Refrain from posting false reviews or feedback that could harm sellers unfairly.

     - Understand that a purchase creates a binding contract with the Seller, and the Buyer must fulfil their obligations (payment, acceptance of delivery, etc.).

3. Seller Role Responsibilities :

   : A Seller lists products or services on DesktopBazar for Buyers to purchase.

     - Ensure that the product descriptions, pricing, and availability are accurate and up-to-date.

     - Fulfill orders promptly after receiving payment from the Buyer.

     - Comply with all applicable laws and regulations, including product safety and intellectual property laws.

     - Provide genuine, quality products and handle returns or disputes by the marketplace’s policies.

     - Deliver products within the promised timeframe and maintain good customer communication.

 Seller Documents Required for Account Opening on DesktopBazar

To create a Seller account on DesktopBazar, Sellers must provide valid documentation to verify their identity, business legitimacy, and compliance with applicable laws. The following documents are generally required for account opening:

1. Proof of Identity (For Individual Sellers):

   - Aadhar Card: A government-issued unique identification number for individuals.

   - PAN Card: The Permanent Account Number (PAN) is mandatory for tax purposes and is issued by the Income Tax Department of India.

   - Passport or Driver’s License: As additional identity proof if required.

2. Proof of Business Registration (For Business Entities):

   - Company Registration Certificate: For businesses registered as a company or partnership, this document proves the legal existence of the entity.

   - Partnership Deed: Required if the business is a partnership firm.

   - Sole Proprietorship Declaration: For sole proprietors, a declaration of business ownership may be required.

   - GST Registration: Goods and Services Tax (GST) certificate to verify that the business is compliant with India's tax regulations.

3. Bank Account Details:

   - Cancelled Cheque or Bank Passbook: Proof of an active bank account in the name of the business or the individual Seller. This is necessary for processing payments and withdrawals.

4. Proof of Address:

   - Utility Bills (Electricity, Water, Telephone): Bills in the name of the business or individual, showing the official business address.

   - Registered Office Address Proof: If the Seller operates from a registered office, an official document providing the address is required.

5. Tax Identification Numbers:

   - PAN Card (For Business): The business’s Permanent Account Number (PAN) for tax filing purposes.

   - GSTIN: The Goods and Services Tax Identification Number, required for businesses selling taxable goods and services.

6. Product or Business Certification (If Applicable):

   - Product Licenses/Approvals: For businesses selling regulated or certified products (e.g., electronics, food items, pharmaceuticals), the necessary approvals and licenses from regulatory authorities must be provided.

   - Trademark/Patent Certificates: If the Seller deals in branded products, trademark or patent certificates are necessary for intellectual property rights verification.

7. Authorized Signatory Details:

   - Board Resolution (For Companies): A resolution passed by the board authorizing a person to act as the signatory for account management.

   - Letter of Authorization (For Partnerships/LLPs): For partnerships and LLPs, a letter authorizing an individual to represent the business on DesktopBazar may be required.

8. Digital Signature (If Applicable):

   - Some sellers may be required to provide a digital signature to authenticate documents submitted during the account opening process.

9. Photographs:

   - Passport-size Photograph: A recent passport-sized photograph of the individual or the authorized representative of the business.

10. Legal Entity Information:

    - MOA and AOA (Memorandum and Articles of Association): For businesses, particularly Private Limited Companies, this provides information about the company’s structure and operations.

By providing these documents, Sellers ensure that their business is verified and can legally transact on DesktopBazar. Once the documents are submitted and verified, the Seller account will be activated, allowing them to list and sell products on the platform.

 User Responsibilities on DesktopBazar

As a User of DesktopBazar, whether a Buyer or Seller, you are required to adhere to certain responsibilities and guidelines to ensure a smooth and lawful experience on the platform. Below are the key responsibilities that every User must follow:

1. Accurate Registration Information:

   - All Users must provide accurate, up-to-date, and complete information during the registration process. This includes full name, contact details, and any other required information.

   - Users are required to keep their account details updated and promptly inform DesktopBazar of any changes.

2. Account Security:

   - Users are responsible for maintaining the confidentiality of their account credentials, including the password. They must ensure that no unauthorized person can access their account.

   - Any suspected unauthorized access or breach must be immediately reported to DesktopBazar.

3. Adherence to Laws:

   - Users must comply with all applicable local, national, and international laws when using the platform. This includes, but is not limited to, laws related to e-commerce, data protection, consumer rights, and intellectual property.

   - Users are prohibited from using DesktopBazar for any illegal activity, including but not limited to fraud, money laundering, or the sale of counterfeit goods.

4. Personal Use of the Account:

   - Buyers should only use their accounts for personal purchases and not for resale purposes, unless registered as a business entity.

   - Sellers must use their accounts for legitimate business activities related to selling products or services on DesktopBazar.

5. Honesty in Transactions:

   - Users are expected to conduct all transactions in good faith. Sellers must provide accurate descriptions of their products, including pricing, and buyers should only initiate transactions they intend to complete.

   - Misrepresentation of any kind, including fake reviews or false claims, is strictly prohibited.

6. Respecting Intellectual Property:

   - Users must not post or share content that violates intellectual property rights. This includes selling counterfeit products or using images, logos, or trademarks without proper authorization.

7. No Misuse of the Platform:

   - Users should not engage in activities that could damage, disable, or impair the platform's functionality. This includes attempting to hack into other accounts, introducing malware, or any other malicious activities.

   - DesktopBazar must not be used for spam, phishing, or any form of unsolicited communication.

8. Maintaining Ethical Conduct:

   - Users must refrain from engaging in abusive, harassing, or offensive behavior toward other Users or DesktopBazar staff. This includes any communication through the platform.

   - Inappropriate or illegal content (including hate speech, threats, or pornography) is strictly prohibited.

9. Payment Obligations:

   - Buyers are responsible for completing payments for products they purchase. Failure to pay for products after committing to a transaction may result in penalties or account suspension.

   - Sellers must honor the pricing they display on their products and deliver them as per agreed terms.

10. No Multiple Accounts:

    - Users are not permitted to create multiple accounts for deceptive purposes. If DesktopBazar suspects a User of having multiple accounts to manipulate the system, such accounts may be terminated.

11. Providing True Information in Listings:

    - Sellers must provide true and accurate information about their products, including detailed descriptions, prices, stock availability, and delivery timelines.

12. Timely Response to Queries:

    - Sellers are required to respond promptly to any buyer queries, complaints, or issues regarding the products sold through DesktopBazar.

    - Buyers are encouraged to communicate with Sellers regarding any issues or clarifications before placing orders.

13. Respecting the Cancellation and Return Policies:

    - Buyers must respect and follow the return, refund, and cancellation policies outlined by DesktopBazar or individual Sellers, depending on the terms of the sale.

14. No Involvement in Prohibited Activities:

    - Users must not use DesktopBazar to promote or sell prohibited items such as illegal drugs, weapons, hazardous materials, or any item that violates local or international regulations.

    - DesktopBazar reserves the right to remove listings or terminate accounts involved in the sale of prohibited items.

15. Respecting Other Users' Privacy:

    - Users must not misuse or disclose personal information of others that they may have access to through the platform. Misuse of other Users’ data, including email addresses or contact details, is strictly prohibited.

Failure to comply with these responsibilities may result in penalties such as account suspension or termination, removal of content, or legal action as per DesktopBazar’s policies and applicable laws.

 Seller Responsibilities on DesktopBazar

Sellers on DesktopBazar are expected to follow specific guidelines to ensure a seamless and transparent marketplace for all Users. Below are the responsibilities that every Seller must adhere to:

1. Providing Accurate Information:

   - Sellers must provide correct and detailed information regarding the products they list. This includes descriptions, pricing, images, stock availability, and delivery times.

   - Any misleading or false information may result in the removal of listings or account suspension.

2. Compliance with Legal Requirements:

   - Sellers must comply with all applicable laws, including those related to e-commerce, consumer protection, and tax regulations.

   - Selling counterfeit, prohibited, or restricted goods is strictly prohibited, and Sellers found in violation may face legal consequences and immediate account termination.

3. Timely Order Fulfillment:

   - Sellers must ensure that all orders are processed and shipped within the stipulated time frame as indicated on the product listing.

   - Delayed fulfillment, unless communicated and agreed upon by the Buyer, may result in penalties or negative reviews.

4. Return and Refund Policies:

   - Sellers must clearly specify return, refund, and exchange policies for each product. These policies must align with DesktopBazar’s platform-wide guidelines.

   - Sellers are responsible for honoring refunds and returns in case of defective products, non-delivery, or any discrepancies in the product description.

5. Customer Support and Communication:

   - Sellers are required to provide prompt customer support and respond to queries, complaints, or disputes raised by Buyers.

   - Communication with Buyers should be professional and helpful to ensure a positive buying experience.

6. Maintaining Stock Accuracy:

   - Sellers must keep their inventory updated and ensure that listed products are available for purchase.

   - In case of out-of-stock products, Sellers should immediately update the listing or temporarily remove it to avoid miscommunication with Buyers.

7. Adherence to Pricing Regulations:

   - Sellers must display accurate pricing, which should include all applicable taxes, fees, and shipping charges. Sellers are prohibited from misleading Buyers by showing hidden charges.

   - Price manipulation or displaying unrealistic discounts to deceive Buyers is not allowed.

8. Prohibited Items and Content:

   - Sellers must refrain from listing prohibited items, which include but are not limited to illegal goods, hazardous materials, stolen goods, and products that infringe intellectual property rights.

   - Listings containing inappropriate, offensive, or misleading content will be removed, and the Seller’s account may be suspended.

9. Respecting Buyer Privacy:

   - Sellers must handle Buyer information responsibly and only use it for processing orders and communication related to the transaction.

   - Misuse of personal information for unsolicited marketing or sharing with third parties is strictly prohibited.

10. Tax Compliance:

   - Sellers are responsible for collecting and remitting any applicable taxes, including Goods and Services Tax (GST) in India.

   - DesktopBazar may require Sellers to provide valid tax information for compliance and regulatory purposes.

11. Product Packaging and Quality:

   - Sellers must ensure that products are packaged securely and meet the required quality standards as described in the listing.

   - Inadequate or damaged packaging leading to product damage during shipment will be the Seller's responsibility.

12. Handling Disputes:

   - Sellers are responsible for resolving any disputes that arise from the sale of their products. DesktopBazar provides a dispute resolution system, but Sellers must actively cooperate to address any Buyer concerns.

13. No Manipulation of Reviews:

   - Sellers are not allowed to manipulate product reviews or ratings by posting fake reviews, offering incentives for positive feedback, or engaging in unethical behavior.

   - Reviews must reflect genuine Buyer experiences.

14. Adherence to DesktopBazar's Policies:

   - Sellers must follow all guidelines, terms, and policies set forth by DesktopBazar, including those related to promotions, pricing, and listing practices.

   - Violation of these policies may result in penalties such as reduced visibility of listings, temporary suspension, or permanent account closure.

15. Providing Required Documentation for Seller Account Opening:

   - Sellers are required to submit the following documents to open and maintain an account on DesktopBazar:

     - Business Registration: Proof of business registration or ownership, such as a company incorporation certificate or GST registration.

     - Tax Information: PAN (Permanent Account Number) and GSTIN (Goods and Services Tax Identification Number) as applicable.

     - Bank Account Information: Verified bank account details for receiving payments.

     - Address Proof: Valid address proof for shipping and business operations.

     - KYC Documents: Know Your Customer (KYC) documents such as an Aadhaar card, passport, or any other government-issued identity verification document.

     - Product Certification: For specific product categories (e.g., electronics, health and wellness), Sellers may be required to submit product quality certifications.

Failure to submit the required documentation or any discrepancies found during verification may lead to the suspension of the Seller's account.

 Transaction Responsibilities on DesktopBazar

A transaction on DesktopBazar refers to the entire process of buying and selling, starting from product listing to payment processing and delivery. Below are the key responsibilities for managing transactions on the platform:

1. Transparency in Transactions:

   - Buyers and Sellers must engage in fair and transparent transactions. Product listings, descriptions, and prices must be accurate, and the Seller must fulfill their obligations to the Buyer.

2. Payment Security:

   - All payments made on DesktopBazar are processed through secure payment gateways. Sellers must ensure they have the necessary setup to receive payments, and Buyers must use only the payment methods provided by DesktopBazar.

3. Order Tracking and Updates:

   - Sellers must provide accurate shipping details, including tracking information, and ensure that Buyers are informed about the status of their order.

   - Buyers should regularly check their order status and contact the Seller in case of any issues or delays.

4. Delivery Responsibilities:

   - Sellers must ensure timely delivery of products, as per the committed timelines. In case of delays, Sellers must communicate with Buyers and DesktopBazar to resolve the issue.

   - Buyers are responsible for providing accurate shipping details and being available to receive the product at the delivery location.

5. Handling Returns and Refunds:

   - Both Buyers and Sellers must adhere to DesktopBazar's return and refund policies. Sellers are required to honor return requests for defective or misrepresented products.

   - Buyers should initiate return requests within the specified time frame and follow the procedures outlined by DesktopBazar for a smooth return process.

6. Dispute Resolution:

   - DesktopBazar offers a dispute resolution mechanism for Buyers and Sellers. Both parties must cooperate with DesktopBazar's support team to resolve any transaction disputes in a fair and timely manner.

By adhering to the roles and responsibilities outlined above, all Users—whether Buyers, Sellers, or marketplace participants—contribute to a positive and lawful environment on DesktopBazar.

 Account Responsibilities on DesktopBazar

1. Account Creation and Maintenance:

   - All Users, whether Buyers or Sellers, must create a personal account on DesktopBazar to access and use the platform's services.

   - The information provided during the account registration process must be accurate and complete. Any falsification of information may result in account suspension or termination.

2. Account Security:

   - Users are responsible for safeguarding their account credentials, including their password and any authentication details.

   - Sharing account details with others is strictly prohibited. In the event of any unauthorized use of the account, Users must notify DesktopBazar immediately to mitigate the risk of fraudulent activities.

3. Updating Account Information:

   - Users must promptly update any changes to their account information, including contact details, payment preferences, and shipping addresses, to ensure accuracy.

   - Failure to maintain current information can result in issues with orders, payments, and communications.

4. One Account per User:

   - Each User is allowed only one account for personal use. Creating multiple accounts for fraudulent purposes or to manipulate the platform’s system is prohibited and may result in permanent suspension from DesktopBazar.

 Content Responsibilities on DesktopBazar

1. User-Generated Content:

   - Users may upload or submit content such as product reviews, ratings, comments, and questions. Such content must be respectful, truthful, and in compliance with applicable laws.

   - Users must not post content that is misleading, offensive, defamatory, or harmful to others.

2. Prohibited Content:

4. Monitoring of Content:

   - DesktopBazar reserves the right to monitor and, if necessary, remove content that violates platform policies, community guidelines, or applicable laws.

   - Users who repeatedly submit inappropriate content may face disciplinary actions, including account suspension.

2. Payment and Transaction Processing:

   - DesktopBazar provides a secure payment gateway for all transactions conducted on the platform. All payment-related information is encrypted and handled with the utmost care to ensure data security.

   - The platform supports various payment methods, including credit/debit cards, UPI, and net banking.

3. Shipping and Delivery Services:

   - DesktopBazar collaborates with logistics partners to ensure the timely and secure delivery of products. Shipping options, costs, and estimated delivery times are communicated to Buyers at checkout.

   - Sellers are responsible for packaging and dispatching products, while DesktopBazar assists in providing tracking information to Buyers.

4. Customer Support:

   - DesktopBazar offers customer support to address any issues related to accounts, transactions, returns, and disputes. Users can reach out via email or through the platform’s support portal for assistance.

   - Sellers and Buyers must cooperate with the support team to resolve any inquiries or conflicts efficiently.

5. Dispute Resolution Services:

   - In the event of a dispute between a Buyer and Seller, DesktopBazar provides a formal dispute resolution process. Both parties must provide necessary documentation and evidence to resolve the matter fairly.

   - DesktopBazar will act as a mediator and will facilitate discussions to arrive at a satisfactory resolution for both parties. 

 Seller Document Requirements for Account Opening

To create a Seller account on DesktopBazar, the following documentation is required for verification:

1. Business Registration Documents:

   - Proof of business registration, such as a Company Incorporation Certificate, GST Registration Certificate, or a Shop and Establishment License.

   - If the Seller operates as an individual (sole proprietor), appropriate documents like the PAN Card or Aadhaar Card must be provided.

2. Tax Information:

   - Sellers must submit their GSTIN (Goods and Services Tax Identification Number) and PAN (Permanent Account Number) details as part of their tax compliance.

3. Bank Account Information:

   - Verified bank account details, including bank statements or a cancelled cheque, are required to set up payment withdrawals from DesktopBazar.

4. Proof of Identity and Address:

   - Valid KYC (Know Your Customer) documents such as a passport, Aadhaar card, or driving license must be submitted to verify the identity of the Seller.

   - Address proof (utility bills, rent agreements, etc.) is required to verify the Seller’s business or operational location.

6. Authorized Signatory Documents (if applicable):

   - Keeping accurate stock levels is crucial to avoid issues with order fulfillment. Repeated failures to fulfill orders due to inventory mismanagement may lead to penalties.

3. Order Fulfillment and Shipping:

   - Sellers are responsible for timely processing, packaging, and dispatching orders to Buyers.

   - They must adhere to the delivery timelines specified in their product listings and work with authorized logistics partners to ensure prompt and secure delivery.

   - Sellers must provide accurate tracking information to both DesktopBazar and Buyers.

4. Compliance with Laws:

   - Sellers must ensure that all products sold on DesktopBazar comply with local laws, including tax regulations, safety standards, and import/export restrictions.

   - It is the Seller’s responsibility to ensure that no counterfeit or illegal products are listed or sold through the platform.

5. Customer Service and Support:

   - Sellers are expected to provide prompt and effective customer service to resolve any inquiries or issues from Buyers.

   - In case of any disputes, Sellers must cooperate with DesktopBazar’s support and dispute resolution teams to reach an amicable solution.

6. Returns and Refunds:

   - Sellers must establish clear return policies and ensure they comply with DesktopBazar’s platform-wide return guidelines.

   - They are responsible for processing refunds and returns in a timely manner and ensuring that Buyers have a hassle-free experience in case of product issues.

 Buyer Responsibilities on DesktopBazar

1. Placing Orders:

   - Buyers are responsible for reviewing all product details, including descriptions, specifications, and shipping information, before placing an order.

   - Once an order is placed, Buyers are obligated to complete the payment process as per the terms mentioned at the time of checkout.

2. Providing Accurate Information:

   - Buyers must provide accurate shipping addresses and contact information to ensure proper delivery.

   - Any errors in the provided information may lead to delivery delays or additional shipping charges, which Buyers may be required to bear.

3. Payment:

   - Buyers are responsible for ensuring that their payment method is valid and that they have sufficient funds to complete their purchase.

   - All transactions must be completed through the platform’s secure payment gateway. Direct transactions outside DesktopBazar are prohibited and may result in penalties.

4. Receiving Orders:

   - Buyers must be available to receive orders at the delivery address provided or arrange for alternate delivery options if necessary.

   - It is the Buyer’s responsibility to inspect the product upon receipt and report any issues to the Seller or DesktopBazar’s customer service within the designated return window.

5. Compliance with Laws:

   - Buyers must use the platform and purchase products in accordance with applicable laws and regulations. Any illegal activity, including fraudulent purchases, may result in account suspension or legal action.

6. Respectful Conduct:

   - Buyers are expected to communicate respectfully with Sellers and DesktopBazar’s support team. Any abusive, harassing, or fraudulent behavior will not be tolerated.

 Transaction Responsibilities on DesktopBazar

1. Contract Between Buyer and Seller:

   - All transactions made on DesktopBazar are legally binding contracts between the Buyer and the Seller.

   - DesktopBazar acts solely as a facilitator and is not a party to the sale. Therefore, any issues regarding the products, such as warranties or product defects, must be resolved between the Buyer and the Seller.

2. Payment Process:

   - Transactions must be completed through the platform’s payment gateway, which supports various payment methods.

   - DesktopBazar ensures secure encryption of all payment information but is not responsible for any issues arising from third-party payment processors.

3. Order Cancellation:

   - Buyers and Sellers may cancel orders in accordance with DesktopBazar’s cancellation policies. Sellers are obligated to cancel orders if they cannot fulfill them due to stock shortages or other issues.

   - If a Buyer cancels an order after dispatch, they may be liable for shipping or return costs as per the Seller’s return policy.

4. Dispute Resolution:

   - In case of any transaction-related disputes, DesktopBazar provides a formal dispute resolution process. Both the Buyer and Seller must provide necessary documentation and cooperate with the platform’s resolution team.

   - DesktopBazar’s decision in disputes will be final and binding on both parties.

3. Prohibited Activities:

   - Users are prohibited from using the platform for any unlawful activities, including money laundering, fraud, or the sale of prohibited items such as counterfeit goods, weapons, or illicit substances.

   - Violation of these laws will result in the immediate suspension of the User’s account and may involve legal action.

By adhering to the roles, responsibilities, and legal requirements outlined above, DesktopBazar aims to foster a transparent, secure, and fair marketplace for all users. Buyers and Sellers are encouraged to follow the platform’s guidelines to ensure a positive and compliant experience.

 Account Responsibilities on DesktopBazar
